2. Services Overview
• The Kutumb Platform acts as a facilitator, enabling transactions between customers and third-party sellers.
• Kutumb Ecommerce Private Limited does not manufacture, own, or sell products directly but provides a platform for transactions.
• The availability of services depends on geographic locations and may be restricted by seller operating hours.
Additional Fees:
• Delivery charges apply for orders below the minimum order value.
• Convenience and safety fees may also apply. These charges will be displayed at checkout.

3. Eligibility
• Legal Age:
Users must be 18 years or older to transact on the Kutumb Platform. Minors may use the platform under adult supervision, but cannot purchase restricted items (e.g., products intended solely for adults).
• End-User Intent:
The Kutumb Platform is for personal, domestic use only. Business users, such as wholesalers or retailers, are not permitted to use the platform for purchases.
• Account Termination:
The Company reserves the right to terminate or restrict access to accounts that do not meet eligibility criteria or violate these Terms.

4. User Responsibilities
As a user, you agree to:
• Provide accurate information during registration and maintain confidentiality of your login credentials.
• Use the Kutumb Platform only for lawful purposes and refrain from activities including, but not limited to:
o Sharing harmful, defamatory, or offensive content.
o Violating intellectual property rights.
o Uploading malicious software or viruses.
o Engaging in fraudulent or deceptive practices.
Prohibited Content:
You must not host, upload, or share any content that:
• Belongs to another person without authorization.
• Harms minors, incites violence, or promotes illegal activities.
• Threatens national security or public order.

5. License and Access
Kutumb grants you a limited, non-exclusive, and revocable license to use the platform for personal use. You agree not to:
• Resell or commercially exploit the Kutumb Platform or its contents.
• Use unauthorized tools like bots or data-mining software.
• Frame or embed proprietary information such as trademarks or logos without permission.
Unauthorized use of the Kutumb Platform will result in termination of this license.

6. Limitation of Liability
Kutumb is not liable for:
• Transactions conducted between users and third-party sellers.
• Product quality, suitability, or pricing.
• Service interruptions or technical issues beyond its control.

7. Intellectual Property Rights
All content on the Kutumb Platform, including text, graphics, logos, and software, is the property of Kutumb Ecommerce Private Limited or its licensors. Unauthorized reproduction or misuse is strictly prohibited.

9. Governing Law and Jurisdiction

By agreeing to these Terms of Use, you consent to receive promotional and transactional communications from the Company and its partners. You may opt out by contacting customer service or submitting a request.
1.3 Information Collection:
During registration, the Company may collect personal information such as:
• Name, email, age, address, and mobile number.
• Identification details (e.g., PAN Card, Aadhaar Card).
• Demographic profile (e.g., gender, occupation, education).
• Browsing details on the Marketplace (e.g., pages visited, links clicked).

1.4 Communication Consent:
By registering your mobile number, you consent to receiving updates via calls, SMS, WhatsApp, and other electronic modes.

2. Pricing
2.1 Accuracy of Pricing:
The Company strives to ensure accurate pricing but reserves the right to cancel orders due to errors or incorrect information.
2.2 Final Price:
The price at the time of order placement is the price charged upon delivery. Products will not be sold above their Maximum Retail Price (MRP).

3. Advertising
3.1 Ad Placement:
The Services may include advertisements, the manner and extent of which may change without notice. By using the Services, you consent to the display of such advertisements.
3.2 Third-Party Advertising:
Responsibility for the content of third-party advertisements lies with the advertiser. The Company is not liable for errors, inaccuracies, or damages resulting from such advertisements.
3.3 Charitable Campaigns:
Information on charitable campaigns is for informational purposes only. The Company is not involved in fund collection or utilization and advises independent verification before participation.

4. Disclaimers
4.1 User Responsibility:

4.2 Third-Party Liability:

5. Reviews, Feedback, and Submissions

By using the Marketplace, you may encounter content deemed objectionable by some. The Company is not liable for any such content.

9. Indemnity
You agree to indemnify the Company and its representatives against all claims, damages, and expenses arising from your breach of these Terms or applicable laws.

10. Limitation of Liability
The Company’s liability is limited to refunding the amount charged for a disputed order. Indirect or consequential damages are not covered.

11. Termination
The Company or user may terminate this agreement at any time. Obligations arising before termination will remain enforceable.

12. Governing Law and Jurisdiction
12.1 The agreement is governed by Indian law.
12.2 Disputes will be resolved through arbitration in Ahmedabad, following the Arbitration and Conciliation Act, 1996.
12.3 Courts in Ahmedabad have exclusive jurisdiction over disputes.

General Agreement
By using the services provided by KUTUMB, you agree to the following terms:
1. Delivery and Returns:
o In case of incorrect delivery details provided by you, additional costs for re-delivery will be borne by you.
o While KUTUMB endeavors to ensure timely delivery, no guarantee is made regarding delivery timelines due to factors beyond its control.
o If you request unattended delivery, KUTUMB is not responsible for any issues arising from it.
2. Usage Guidelines:
o Use the services for lawful purposes only and comply with applicable laws.
o Provide authentic information whenever requested. False or inaccurate information may lead to cancellation of orders or termination of services without notice.
o Review product descriptions carefully before placing orders.
3. Order Cancellation and Substitution:
o Orders may be canceled for reasons such as fraudulent activity, non-compliance, unavailability of products, or logistical issues.
o Refunds for canceled orders will be initiated within 72 hours.
o KUTUMB may replace unavailable items in your order, subject to your acceptance.
GST Compliance
1. KUTUMB processes orders in line with GST guidelines.
2. Your order will include:
o A delivery statement listing all ordered items.
o Tax invoices and bills of supply for applicable items.
3. Benefits from GST, including lower-priced items, will be passed on to you.
Order Limitations
1. A customer can place up to 5 live orders at a time.
2. Delivery charges vary by store and are displayed at checkout.
3. Additional fees such as delivery, surge, or packaging fees may apply and will be disclosed before order placement.
Returns and Refunds
1. Products are non-returnable unless damaged, defective, expired, or incorrectly delivered.
2. Refunds will be processed within 7 days of product return, subject to checks.
3. Refunds will generally be credited back via the original payment method, unless processed as promotional codes.
4. Promotional codes are non-transferable and have a specified validity period.
Cashback Policy
1. Cashback, if eligible, will be credited to the user’s KUTUMB Wallet and cannot be transferred to a bank account or refunded as cash.
2. Cashback is subject to cancellation or adjustment in case of returned or canceled orders.
3. Cashback offers cannot be clubbed with other offers and will expire after a specified duration.
Promotional Campaigns
1. Offers are subject to change or withdrawal without prior notice.
2. Refunds or cancellations will void any associated offers or benefits.
3. KUTUMB is not liable for third-party services or issues arising from promotional campaigns.
Specific Terms for Tobacco Products
1. Customers purchasing tobacco products must:
o Be at least 18 years of age.
o Reside outside a 100-yard radius of educational institutions.
2. Government identification is required at the time of order placement and delivery.
3. Orders for tobacco products may be canceled if these conditions are not met.
UPI Payments
1. UPI is a real-time payment system for instant fund transfers.
2. Refunds for UPI transactions will reflect in your account within 5–7 working days post-initiation.

Manufacturer-Direct Deliveries
1. Refund/replacement requests for items delivered in 5–7 days must be made within 7 days of delivery.
2. Returns are not accepted post 7 days of delivery or for products marked “non-returnable.”
3. Refunds will be initiated once the returned item is received and verified.
Wholesale Trading
1. Wholesale orders are governed by the terms set on the KUTUMB platform, unless explicitly stated otherwise.
Legal Jurisdiction
Disputes will be subject to the jurisdiction of the courts in Mumbai, India.
